Terms of Service

1. Acceptance of Terms

By accessing or using the FullOut platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and FullOut ("we," "us," or "our").

2. Description of Service

FullOut is a competitive cheerleading analytics platform that aggregates publicly available competition data—including scores, rankings, team information, and performance statistics—and provides analytical tools, insights, and tracking features. The Service may include free and paid subscription tiers with varying levels of access.

3. User Accounts

  • You must provide accurate, complete, and current information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

  • Certain features require a paid subscription. Pricing is displayed on our pricing page.
  • Subscriptions automatically renew unless canceled before the renewal date.
  • All fees are non-refundable except as required by applicable law or at our sole discretion.
  • We reserve the right to change pricing with reasonable notice to subscribers.
  • Failure to pay may result in suspension or termination of your subscription.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Scrape, crawl, or use automated means to access the Service or extract data without our express written permission

  • Reverse engineer, decompile, or disassemble any portion of the Service
  • Use the Service to build a competing product or service
  • Impersonate any person or entity or misrepresent your affiliation
  • Upload or transmit viruses, malware, or other harmful code
  • Circumvent or attempt to circumvent any access controls, rate limits, or usage restrictions

6. Intellectual Property

The Service, including its design, features, code, graphics, logos, and all content created by FullOut, is owned by FullOut and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

Competition data displayed on the Service is aggregated from publicly available sources. Our compilation, organization, analysis, and presentation of this data constitutes our proprietary work product and is protected by applicable intellectual property laws.

7. Data Accuracy Disclaimer

While we strive for accuracy, the data on our platform is aggregated from third-party public sources. We do not guarantee the accuracy, completeness, or timeliness of any data. The Service is provided for informational and analytical purposes only and should not be relied upon as the sole source of truth for competition results.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FULLOUT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

10. Indemnification

You agree to indemnify, defend, and hold harmless FullOut and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your conduct in connection with the Service.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive, including but not limited to intellectual property, disclaimers, indemnification, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FullOut regarding the Service and supersede all prior agreements and understandings, whether written or oral.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
